    Short-haul drivers exempted from break requirement

    The Federal Motor Carrier Safety Administration (FMCSA) has issued a final rule providing an exception to the mandatory break requirement for short-haul drivers.

    According to the final rule, if a driver qualifies for the 100 air-mile radius exception or the 150 air-mile short-haul exception, he/she is not required to comply with the 30-minute break.

    This rule is in response to a decision by the U.S. Court of Appeals for the District of Columbia Circuit that vacated the mandatory 30-minute break provision for short-haul drivers.

    This exception only applies to drivers qualifying under the 100 air-mile radius exception or the 150 air-mile short-haul exception. All other drivers must continue to comply with the mandatory break provision, and shall not drive if more than 8 hours have passed since the driver’s last off-duty or sleeper-berth period of at least 30 minutes.

    The final rule took effect on October 28, 2013.

    Good one and avoids most of accidents by truck drivers due to sleepless continuous driving

    This was a good exemption and has benefited our industry greatly. It was bad for drivers who have to report back to work before going home

    The short haul exemption is a bit confusing. I read about if but it doesn't really make it clear what qualifies you for the exemption.
